وفى نطاق الإدعاء يوجد من يدعى ومن يُدعى عليه، ألا أن الحق قد لا يكون ثابتاً بطريقة واضحة ظاهرة لأى من هذين الطرفين فقد يكون متراوحاً بينهما، ولذلك فإن تعيين من يقع عليه عبء الإثبات مسألة بالغة الأهمية من الناحية العملية؟ لأن المقصود بعب الإثبات هو تكليف أحد المتداعيين بإقامة الدليل على صحة ما يدعيه؟ ولا يُسمى التكليف بالإثبات عبئاً لأنه حمل ثقيل ينوء به من يُلقى عليه؟ وإنما لأن من كُلف به قد لا يكون مالكاً للوسائل التى يتمكن بها من إقناع القاضى بصدق ما يدعيه، وتكمن أهمية من يحمل عبء الإثبات من الخصمين كونه يعد أول تنظيم لقواعد الإثبات إذ يتصل بتعيين مَن مِن الخصمين يحمل عبء الإثبات؟ أى مَن منهما يكلف بالإثبات دون الآخر؟.
وتعيين من يحمل عبء الإثبات من الخصمين يكاد يتوقف عليه فى كثير من الأحوال مصير الدعوى من الناحية العملية.
هذه الدراسة محاولة من الباحث للإجابة على الأسئلة التى سبق طرحها لإيجاد حلول عملية لتجنب الوقوع فى الأخطاء التى ترتكب أثناء تطبيق قواعد الإثبات الموضوعية، وقد إعتمدت هذه الدراسة على المنهج التحليلى الموضوعى فى تناولها للنصوص القانونية التى أوردها المشرع اليمنى، مما مكنها من تتبع وإيضاح قواعد الإثبات الموضوعية والإجرائية فى التقنين اليمنى والتشريعات الأخرى، أما عن تقسيم الدراسة فقد قسمت إلى ثلاثة مباحث نوجزها على النحو الآتى:
التمهيدى: وفيه تعريف الإثبات ومراحل تطوره.
المبحث الأول: قواعد الإثبات وفيه أهمية الإثبات ومكانته وأركانه.
المبحث الثانى: عبء الإثبات فى الدعوى المدنية ودور القاضى فيها.
المبحث الثالث: عبء الإثبات فى الدعوى المدنية ودور القاضى فيه.
الخاتمة: تتضمن النتائج التى توصل إليها الباحث وأهم التوصيات.
