يعد الخصم العنصر الأساسي في الدعوى المدنية إذ لا دعوى بدون خصم ولا خصم أمام القضاء بدون دعوى، فمن هنا تأتي أهمية هذا الموضوع في قانون المرافعات المدنية، إلى جانب إهتمام القوانين الموضوعية بعدة جوانب من هذه الدراسة.
أما في الجانب التطبيقي فأن هذا الموضوع يعد الشغل الشاغل للمحاكم، إذ تواجه صور الخصم وحالاته كلاً من القاضي والمحامي والموظف الحقوقي وبشكل مباشر إلى جانب أهميته للآخرين بسبب تشابك المصالح وما يترتب عليها من آثار.
ونلخص دواعي لذلك إختار المؤلف هذا الموضوع ليتناوله في هذه الدراسة بالجوانب الآتية:
1- لندرة الدراسات والبحوث القانونية في هذا المجال.
وقد إقتضت دراسة موضوع (الخصم في الدعوى المدنية) تناوله في ثلاثة فصول يتضمن الفصل الأول ماهية الخصم وتم تغطيته بمبحثين الأول لمفهومه والثاني لصوره، تم عرضه في مبحثين الأول للتمثيل الإجباري والثاني للتمثيل الإختياري.
وفي الفصل الثالث والأخيلا تصدى للآثار المترتبة على إكتساب وصف الخصم تبينت في مبحثين الأول الآثار بعد إقامة الدعوى حتى صدور الحكم والثاني للآثار بعد صدور الحكم.
