قسم الفقهاء طرق الإثبات إلى أقسام مختلفة منها طرق مباشرة وطرق غير مباشرة، وطرق ذات حجية ملزمة وطرق ذات حجية غير ملزمة وطرق أصلية وطرق تكميلية وطرق إحتياطية وطرق ذات قوة محدودة وطرق معفية من الإثبات.
وهذه التقسيمات جميعاً ترتكز على ما لكل طريقة من قوة في الإثبات والقوة في الإثبات هي التي تميزها عن الطرق الأخرى.
والإثبات: هو إقامة الدليل أمام القضاء بالطرق التي حددها القانون وبالقيود التي رسمها، على وجود واقعية قانونية متنازع عليها؛ ومن طرق الإثبات التي حددها قانون الإثبات رقم 107 لسنة 1979 هي الخبرة بالمواد من 132 إلى 146 منه.
ونظراً لكون الخبرة من طرق الإثبات وإن مهنة الخبراء أمام القضاء من المهن المهمة والخطيرة، فإن الخبير هو عون القاضي فيضع تحت تصرف معارفه وتجاربه له، ما خفي أو شكل من الأمور يثير ويهيئ له الطريق للفصل في النزاع المعروض عليه على أساس سليم؛ وحيث أن الخبرة تعتبر وسيلة من وسائل الإثبات التي تهدف إلى الوصول إلى الحقيقة وتساعد القاضي في الدعوى البدائية والشرعية والإستئنافية من الوصول إلى الحكم العادل عند إصدار القرار.
ونظراً لأهمية الخبرة في المسائل المدنية، بحث الكتاب هذا الموضوع بشكل تفصيلي وذكر القرارات التمييزية وذلك لخطورة هذه المهمة على القضاة.
وقد تم تقسيم الكتاب إلى ثلاثة أبواب وفق ما يلي: الباب الأول: "ماهية الخبرة وطبيعتها القانونية"، الباب الثاني: "أداء الخبير لمهمته"، "الباب الثالث: "إجراءات إنتخاب الخبراء".
