إن تحقيق العدالة بين الناس يعتبر من أخص المهام الرئيسة لجهاز القضاء لا يصل إليها إلا إذا قام هذا الجهاز بفحص وقائع كل حالة من الحالات وظروفها التي تعرض عليه، ليتمكن من خلالها الوقوف على الإختلال في التوازن ما بين المصالح المتضاربة ليستنتج الحلول المناسبة التي تؤدي إلى تحقيق العدالة.
والقضاء لا يستطيع في كل حالة أن يحقق هذا الهدف إلا إذا أعانه المحامي على ذلك بما له من سعي فكري وخبرة تمهد لهُ الطريق للوصول إلى الحقيقة لكي يكون حقاً رسول الناس لدى العدالة ورسول العدالة لدى الناس، وبذلك يكون للمحامي دور يضطلع به ويساهم من خلاله مساهمة فاعلة للوصول إلى الحكم العادل.
وإزاء تنوع هذه المسؤوليات وتفرعها ومعالجة القوانين والتشريعات لها بمختلف النصوص إزداد دور المحامي أهميةً مما جعل الحاجة إليه ضرورية لا غنى عنها فيمكن للأفراد أن يستعينوا بآرائه النيرة ومشورته الصائبة فهو الذي يدرك كل ما يستعصي على الأفراد من أمور فيبذل النصح وهو الذي يعلم أين يبدأ الحق وأين تقف حدودهُ وما هي الحرية وأين تنتهي وهو الملم بكل ما تنطوي عليه القوانين من معانٍ وأهداف يسعى إلى تحقيقها.
وعليه فقد قسم هذا الكتاب إلى ثلاثة فصول: تناول المؤلف في الفصل الاول: تحديد مفهوم المحامي، وذلك من خلال ثلاثة مباحث درست التطور التاريخي لمهنة المحاماة في الحضارات الشرقية القديمة والحضارات الغربية القديمة وتعريف المحامي وخصائص مهنة المحاماة وشروط ممارسة مهنة المحاماة في الشريعة الإسلامية والقوانين الوضعية، تطرق إلى الأساس القانوني لعمل المحامي.
أما الفصل الثاني فقد خصص لدراسة حقوق المحامي وواجباته، وذلك من خلال تقسيمه إلى ثلاثة مباحث درسة حقوق المحامي التي أقرتها القوانين المختلفة، وكذلك وجوب تمتع المحامي بالحصانة لتمكينه من ممارسة عمله بالإضافة إلى حقه في تقاضي الأتعاب؛ أما الفصل الثالث والأخير فقد بحث فيه إلتزام المحامي بمتابعة الدعوى المدنية من خلال بيان طبيعة الدعوى المدنية وتعريفها وشروطها، كما بحث فيه حضور المحامي للمرافعة والإستمرار فيها سواء أكان حضوره شخصياً أم عن طريق الإنابة، كما بحث دور المحامي بعد صدور الحكم سواء كان الحكم صادراً ضد موكله في الدعوى.
