تعد حرية التعبير عن الرأي أهم الحريات العامة على الإطلاق، فهي أساس كا نظام ديمقراطي وأدعى للاستقرار الاجتماعي بما تؤدي إليه من حسن العلاقة والتفاهم بين الحاكم والمحكوم، ويمكن القول إن وسائل الإعلام قد صارت في صدارة المشهد السياسي والإقتصادي والإجتماعي.
ومن خلال منهج وصفي تحليلي تقوم هذه الدراسة على فصل تمهيدي نستعرض فيه أهمية حرية التعبير عن الرأي من خلال وسائل الإعلام مبينين مصادر وحدود حرية التعبير، وثلاثة أبواب، وفي الباب الأول نبين القيود الموضوعية في إطار قانون العقوبات، مستعرضين فيه أهم الجرائم المرتكبة بواسطة وسائل الإعلام، ومدى تحقيق النصوص القانونية للتوازن المطلوب بين حرية التعبير عن الرأي من خلال وسائل الإعلام لما يؤدي إليه من دور جوهري في تحقيق التقدم والتنمية، وبين حماية النظام القانوني برمته في الدولة، وندرس في الباب الثاني القيود الإجرائية على حرية التعبير عن الرأي من خلال وسائل الإعلام فيما يتعلق بالإثبات والاختصاص القضائي، والمسئولية الجنائية، والأحكام الخاصة بالحبس الاحتياطي.
