المشرع عندما وضع النظام القانونى لإحالة إلى الاحتياط استهدف به مواجهة حالات محددة، الحالة الأولى- لأسباب تتعلق بعدم اللياقة الصحية والحالة الثانية- لأسباب جدية تتعلق بالصالح العام، وهذه الحالة الثانية تكون بقصد تنبيه المحال إلى انهيار سلوكه أو اعوجاج انضابطه فيوضع فترة تحت الرقابة والفحص.
فهى تؤدى إلى نتائج خطيرة لذلك اختص المشرع إيقاعها بضوابط وشروط خاصة، وأياً كانت الضوابط والشروط، فإن الإحالة إلى الاحتياط لازالت حتى الان إجراء يحتاج لقدر من الضمانات ولاسيما أنها تتم دون تحقيق يجرى مع الشابط يواجه فيه بما هو منسوب إله ويكنه من الدفاع عن نفسه وتحقيق دفاعه ولاشك ان إجراء هذا شانه فى الدقة والحساسية والخطورة لجدير بالتأمل والدراسة، ولهذا اخترناه موضوعاً لمؤلفنا حتى نلقى الضوء عليه فى دراسة تحليلية مقارنة.
وقد عالجنا هذا الموضوع فى ثمانية فصول على النحو التالى:
الفصل الأول: الإحالة إلى الاحتياط فى قوانين التوظف، الفصل الثانى: ماهية الإحالة إلى الاحتياط وطبيعتها القانونية والتفرقة بينها وبين الوقف الاحتياطي، الفصل الثالث: القواعد والإجراءات التى تنظم الإحالة إلى الاحتياط، الفصل الرابع: واجبات وحقوق الموظف المحال إلى الاحتياط، الفصل الخامس: الطعن بالإلغاء على قرار الإحالة إلى الاحتياط، الفصل السادس، أسباب الطعن بالإلغاء على قرار الإحالة إلى الاحتياط، الفصل الثامن: التعويض عن قرار الإحالة إلى الاحتياط غير المشروع.
