العقوبة المقدرة شرعاً هي موضوع هذا المؤلف وهي التي نخصها بالأحكام أو القواعد التي تكون محل البحث، وذلك باعتبارها قواعد عامة تحكم هذه العقوبات من حيث الصياغة في قانون يمكن أن يطلق عليه قانون العقوبات الشرعية، أو من حيث تطبيق وتنفيذ أحكام هذا القانون مع بيان مجالات تطبيقه وأحوال تطبيق قانون العقوبات الوضعي النافذ حالياً، وذلك بقصد إزالة أي تعارض أو نزاع بين أحكام قانون العقوبات الشرعية وقانون العقوبات في أية دولة، سواء كان هذا التعارض حقيقياً أو متوهماً.
وعلى هذا قسمنا البحث إلى قسمين، القسم الأول: (نبحث فيه "ضبط المصطلحات والمفاهيم العامة التي تثيرها دراسة نظرية الحدود الشرعية وذلك في مجال التجريم والمسئولية الجنائية وضمانات التطبيق)، والقسم الثاني: (نحدد فيه "الواقعة النموذجية للجريمة الحدية ونظرية الإثبات في الفقه الجنائي الإسلامي).
