إذا ارتكب شخص ما جريمة واحدة فهو بالتالي يستحق عقوبة واحدة حسبما هو مقرر لتلك الجريمة، غير أنه قد يرتكب الشخص ذاته عده جرائم منصوص على عقوباتها في صلب قانون العقوبات كل منها تدخل تحت نص تجريمي معين وتعدد عقوباتها بتعدد جرائمه، فتعدد العقوبات نتيجة حتمية لتعدد الجرائم.
ويعتير موضوع تعدد الجرائم من الأهمية بمكان من بين موضوعات القانون الجنائي، وتلك الأهمية ليست في نطاق العقوبات الواجب تطبيقها وما إذا كانت تتعدد بتعدد الجرائم، وبالتالي تطبق على الجاني عقوبة واحدة لا غير، وإنما ذلك أيضاً في مجال النظرية العامة للجريمة باعتبار أو وحدة أو تعدد الجرائم يبني على دراسة وحدة أو تعدد السلوك الإجرامي ذاته.
كما أن الآثار القانونية للتعدد تتبين أيضاً بالنسبة للمساهمة الجنائية وتطبيق قواعد تقادم الجريمة.
ومن ناحية أخرى فإن تعدد الجرائم يثير مشكلة العلاقة بينه وبين تعدد القواعد القانونية والتنازع الظاهري بين النصوص.
وتعدد الجرائم هو حالة الشخص الذي يرتكب عدة جرائم قبل أن يتم الحكم عليه نهائياً في واحدة منها.
وفي هذا الكتاب سنقوم بدراسة هذا الموضوع في فصلين اثنين:
الفصل الأول:- تعدد الجرائم وأثره في العقوبات في قانون العقوبات الليبي.
الفصل الثاني:- تعدد الجرائم وأثره في العقوبات في القانون الجنائي المغربي.
