إن موضوع هذا المؤلف يعتبر من أهم الموضوعات أو الأعمال التي يقوم بها المحامي، وهو إعداد وتحضير مذكرات الدفاع في القضايا الجنائية، وكذلك إعداد وتحضير صحف الطعن بالنقض في الأحكام الجنائية المعيبة، ونكاد نجزم وبكل ثقة أن إعداد وصياغة مذكرات الدفاع وكذلك صحف الطعون بصفة عامة إنما هي عملية تعتمد على مقومين أساسيين، هما العلم والطريقة، فأما عن العلم لأن المحامي سلاحه في عمله هو علم القانون على اختلاف أفرعه، سواءً أكان قانون العقوبات أو قانون الإجراءات الجنائية أو القوانين المكملة لهما، أو القانون المدني، أو أي قانون آخر، هذا من ناحية، كما أن المحامي في عمله خاصة فيما يتعلق بكتابة المذكرات يتعامل أيضاً مع المبادئ التي قررها القضاء وعليه أن يرجع إلى السوابق القضائية في الموضوع الذي يكتب فيه، وكذلك آراء الفقه وشراح القانون في كل أفرع القانون، وهذا من ناحية ثانية، الأمر الذي دعانا للقول بأن إعداد وصياغة مذكرات الدفاع وصحف الطعون، تعتمد أول ما تعتمد على العلم.
وأما عن الطريقة فإن العلم في أمس الحاجة إلى طريقة لعرضه وتبسيطه ليصل إلى مدارك المحكمة، والعلم بدون طريقة سهلة ومتقنة لا قيمة له، إذ يظل حبيس عقل وفكر المحامي، غير منتفع به، وموضوع هذا المؤلف يفرض علينا، قبل أن نتكلم عن كيفية إعداد مذكرة الدفاع أو صحيفة الطعن بالنقض، أن نتكلم عن العمليات التي يجريها أو يقوم بها المحامي المدافع عن المتهم حتى يتحقق من حقيقة موقف المتهم، وما إذا كانت أوراق القضية تؤهل للحصول على حكم ببراءته مما هو منسوب إليه، أو أن موقفه من الصعوبة بمكان، فلا يكون أمام المحامي سوى مخاطبة وجدان المحكمة لمعاملة المتهم بمنتهى الرأفة، الأمر الذي يستوجب أن نقسم هذا المؤلف إلى قسمين: القسم الأول: قواعد إعداد وصياغة مذكرات الدفاع في القضايا الجنائية، وينقسم القسم الأول من هذا المؤلف إلى ثلاثة أبواب كالتالي: الباب الأول: العمليات التي يجريها محامي المتهم للوقوف على حقيقة موقفه من حيث البراءة أو الإدانة، الباب الثانى: كيفية إعداد مذكرات الدفاع وصحف الطعن بالنقض في القضايا الجنائية، الباب الثالث: دور المحامي في تكوين وترسيخ عقيدة القاضي الجنائي نحو استعمال منتهى الرأفة مع المتهم، القسم الثاني: نماذج من مذكرات الدفاع في القضايا الجنائية "تطبيقات على القسم الأول".
