تأثرت التشريعات العربية إجمالاً بالتشريع الفرنسي فأخذت عنه المبادئ الرئيسية لنظام الإفلاس وفي مصر أخذ قانون التجاري المصري الصادر سنة 1883 فيما يتعلق بنظام الإفلاس بقواعد الإفلاس الفرنسي الصادرة سنة 1807 بعد تعديله بقانون سنة 1838 وكذلك أخذت مصر بنظام الصلح الواقي الذي تم تعديله بالقانون رقم 56 لسنة 1945 والقانون رقم 17 لسنة 1999 بشأن قانون التجارة الجديد.
وبناء على هذا سوف نتناول دراسة نظام الإفلاس بحسب الترتيب الزمني أي منذ الوقت الذي يشعر فيه التاجر المدين باضطراب أعماله وإشرافه على الإفلاس إلى الوقت الذي تنتهي فيه التفليسة وذبك في قسمين:
القسم الأول: (يتناول الإفلاس) ، القسم الثاني: (يتناول الصلح الإحتياطي أو الواقي).
