كانت كلمة التوقيع في زمن ليس ببعيد تعني أن أحد أطراف العقد يكتب اسمه سواء كتبه بطريقة عادية أو بفورمة مميزة أو أن يضع بصمة اصبعه أو بختم مميز خاص به، أي أن التوقيع كان له شكل محدد ومعنى واضح وكانت حالاته معروفة ومحددة على سبيل الحصر.
أما الآن فالتوقيع له معنى وشكل مختلف تمامًا عن معناه وشكله التقليدي القديم، فالتوقيع بمعناه المستحدث أصبح له معنى آخر ألا وهو التوقيع الالكتروني.
وظهر هذا التوقيع في مجال المعاملات البنكية ومن خلال استخدام البطاقات البنكية سواء في عمليات السحب من ماكينة الصرف الآلي المتواجدة خارج مقار البنوك العاملة أو نتيجة سداد ثمن مشتريات من بعض المحالات.
ونظرًا لانتشار عمليات التجارة الالكترونية وبالتالي انتشرت ظاهرة التوقيع الالكتروني لأنه الأساس التي ترتكز عليه عمليات التجارة الالكترونية فقد اتجهت دولًا لوضع تعريفًا له منها مصر في القانون رقم 15 لسنة 2004 بتنظيم التوقيع الالكتروني.
وهو ما حدانا لوضع هذا المؤلف عن وسائل الاتصال الحديثة وحجيتها في الإثبات، ويشمل الآتي: التوقيع وعناصره ودوره في الإثبات، التوقيع الرقمي، مدى استجابة المشرع المصري والكويتي للإثبات بوسائل الاتصال المرئية، التوقيع الالكتروني في مصر ودولة البحرين وتونس وإمارة دبي والإمارات العربية وحجيته في الإثبات، الجزاءات المترتبة على مخالف قانون التوقيع الالكتروني.
