القبض على إنسان ولو لمدة ساعات قليلة إجراء خطير لما فيه من اعتداء على حريته الشخصية. وهو من إجراءات التحقيق لا الاستدلال. لذا لا يكون بحسب الأصل إلا بأمر من سلطات التحقيق دون غيرها .
كان قانون الإجراءات الجنائية فى المادة 34 قبل تعديلها بالقانون رقم 37 لسنة 1972 يتوسع فى حالات القبض بمعرفة مأمزري الضبط القضائى أسوة بقانون تحقيق الجنايات الملغى، فكانت هذه المادة تشمل حالات يجوز فيها القبض عند توافر التلبس بالجريمة. وحالات أخرى يجوز فيها القبض بغير تلبس .
ولكن بعد صدور دستور سنة1971 بما نص عليه فى المادة 41 منه رؤى قصر القبض بمعرفة مأموري الضبط القضائى من غير اعضاء النيابة على حالات التلبس وحدها.
