ولما كان أسلوب التعليق على النصوص التشريعية إنما يرمي وبالدرجة الأولى إلى شرح تلك النصوص وهي بذاتها المهمة التى تدور حولها كل المؤلفات الفقهية, فضلا عن أى تقديم النص معلقا عليه بآراء الشرح وأحكام محكمة النقض يتيح الإلمام بالفهم الذى لقيه فى التطبيق بما يلقى الضوء على مواطن القصور فيه أو الحاجة إلى تطويره.
لذا فسوف نتعرض بمشيئة الله وعونه لشرح نصوص مواد قانون الإجرءات الجنائية مادة تلو الأخرى كما جاءت بالتشريع المصري شرحا موجزا غير مخل تارة وبإسهاب غير ممل تارة أخرى. ثم نعقب بعد شرح كل مادة بما استقرت عليه أحكام محكمة النقض منذ تاريخ إنشاءها حتى عام 2004
