Book Description
الأحكام الجزائية والقرارات الجزائية هي غاية المتخاصمين أمام القضاء وهدفهم، فالغرض من رفع الخصومة إلى القضاء؛ ومن السير فيها وإثباتها هو الوصول إلى حكم يتفق مع حقيقة مراكز الخصوم ويبين حقوق كل منهما فيضع حداً للنزاع بينهم، وليست المحاكم والإجراءات سوى أدوات أو وسائل لهذا الهدف الأخير.
أما الحجية في المجال الإجرائي، فهي تساعد على تحقيق السياسة الجنائية لمشرع العقوبات إذ أن شعور المخاطب بأحكام قانون العقوبات بأن إقدامه على إرتكاب الجريمة ستؤدي به إلى حكم بات لا يقبل التعديد ولا يقبل الإلغاء، تجعله يتردد قبل إرتكابها.
في ضوء ما سبق يضع الأستاذ جاسم خريبط خلف / رئيس قسم القانون - كلية شط العرب في العراق، هذه الدراسة التي تتلائم مع ما أخذ به المشرع العراقي في قانون أول المحاكمات الجزائية رقم 23 لسنة 1973 في الفصل التاسع، حيث تناول في المواد (227، 228، 229) موضوع الحجية تحت عنوان (حجية الأحكام والقرارات الجزائية)، وهو عنوان يتفق مع ما تعارف عليه القانون والفقه والقضاء في فرنسا ومصر ومعظم الدول العربية، لتعبير "حجية الشيء المحكوم فيه" أو "حجية الأمر المقضي به".
تتألف الدراسة من أربعة فصول، يسبقها تمهيد يتضمن نظرة تاريخية في حجية الأحكام والقرارات الجزائية، إذ يتناول الفصل الأول ماهية الأحكام والقرارات الجزائية، فيما يتناول الفصل الثاني مفهوم حجية الأحكام والقرارات الجزائية، وأما الفصل الثالث فخصص لأثر جدية الأحكام والقرارات الجنائية، وفي الفصل الأخير حجية الحكم المدني أمام المحاكم الجزائية... وأخيراً خاتمة وإستنتاجات.
