Book Description
بتاريخ 1 أيار 1960 صدر قانون العقوبات الأردني رقم 16 لسنة 1960 ليصبح ساري المفعول بعد مرور شهر على نشره في الجريدة الرسمية.
وقد استمد هذا القانون مجموعة كبيرة من أحكامه - إلا فيما ندر - من قانون العقوبات اللبناني الذي صدر في أول آذار 1943، ويمكن القول بأن هذا القانون "شأن القانون اللبناني" قد جاء بأحكام جديدة استمدها من ينابيع كلاسيكية شائعة في القوانين الغربية ذات الأصل اللاتيني.
إلا أنه يمتاز عنه بأنه ضم في ثناياه عدداً من الأحكام التي استمدها من قانون العقوبات الإنجليزي الذي كان طبقاً في فلسطين زمن الإنتداب كما هو الحال في بعض أحكام الإشتراك الجرمي، والمادتين 91 و92 في القسم العام منه، وجوانب محدودة من موانع العقاب، بالإضافة إلى عددٍ كبيرٍ من النصوص الناظمة لجرائم تزوير العملة وتزييفها وكذلك لجرائم الذم والقدح والتحقير.
تناول هذا البحث الأحكام العامة في قانون العقوبات، ولما كان الكلام على هذه الأحكام يقتضي الكلام على موضوعات أربعة: هي الجريمة والإشتراك الجرمي (المساهمة في الجريمة) والمسؤولية الجزائية وما يترتب عليها من جزاء متمثل في عقوبة أو تدبير إحترازي، لذا خصص المؤلف لهذه المواضيع أقساماً أربعة يتناول كل قسم منها موضوعاً واحداً من المواضيع المذكورة آنفاً على الترتيب المشار إليه أيضاً.
