موضوع تعويض تفويت الفرصة يبحث في مسألة المضرور الذي توفرت له فرصة حقيقية لتحقيق كسب مرجح لكنه إحتمالي، وضاعت فرصته بفعل محدث الضرر، مما ألحق به ضرراً إحتمالياً، لا يستطيع المطالبة بالتعويض الكامل عنه، لكن له المطالبة بتعويض جزئي عن ضرر تحقق يعدل قيمة ما كان للفرصة الفائتة من درجة إحتمال لتحقيق ذلك الكسب النهائي.
لذا سنحاول في هذه الدراسة التوفيق بين حق المضرور في التعويض، بإعتباره مقابلاً وجبرا للضرر الذي يصيبه وبين حق محدث الضرر في الضرر في تحقق ذلك الضرر والتيقن منه فلا تعويض حيث لا ضرر.
وعليه، بإعتبار هذه الدراسة الأولى من نوعها في الأردن فإنها ستكون محاولة لمعالجة جوانب الضعف والغموض والنقص والقصور الذي يعاني منه موضوع تعويض تفويت الفرصة الذي لم يحظ بالبحث والدراسة من الفقه الأردني وما زال يعاني من الغموض والنقص والقصور في كثير من جوانبه.
