أدى تطور دور الدولة وإتساع نشاطها الإداري في العصر الحديث إلى ممارسها العديد من السلطات، والتمتع بالإمتيازات في مواجهة الأفراد، حتى تتمكن من القيام بمسؤوليها في تسير المرافق العامة، والحفاظ على النظام العام وتحقيق الصالح العام.
غير أن ممارسة الدولة لهذه السلطات قد يؤدي إلى المساس بحقوق وحريات الأفراد، ولذلك فقد أصبح من الضروري تحقيق نوعاً من التوازن والعدالة بين حق الدولة في ممارسة نشاطها الإداري، وحق الأفراد في حماية حقوقهم وحرياتهم، ويتحقق ذلك من خلال إلتزام الدولة في كافة تصرفاتها بالقانون، وهو ما يطلق عليه "مبدأ المشروعية" الذي يحكم كافة الدول المعاصرة، ويتولى القضاء الإداري مهمة الرقابة على أعمال الإدارة للتأكد من مشروعيتها بإعتباره يمثل الحماية والضمان لحقوق وحريات الأفراد ضد تعسف الإدارة.
ويتم ذلك من خلال دعوى قضائية يطلق عليها "عدوى الإلغاء" يرفعها الأفراد المتضررين من القرار الإداري الصادر من الإدارة.
ويطالب فيها بإلغاء القرار الإداري، فإذا ما توافرت شروط قبول دعوى الإلغاء من الناحية الشكلية، تبدأ المحكمة في بحث الشروط الموضوعية وفي أوجه إلغاء القرار الإداري، ويقصد بها العيوب التي تصيب القرار الإداري وتجعله غير مشروع، فإن تبين للمحكمة أن القرار أصابه عيب من تلك العيوب، تعين على القضاء الإداري إلغاء هذا القرار لعدم مشروعيته.
