قال الإمام السرخسي (إعلم بأن القضاء بالحق أقوى الفرائض بعد الإيمان بالله تعالى وهو من أشرف العبادات وبه أمر كل بنى مرسل حتى خاتم الأنبياء) ، والقضاة هم أهم العناصر البشرية التي تظهر في العملية القضائية، وهم مصابيح مضاءة تنير طريق الحق، ودروعاً متينة، تمنع الظلم وتكتبه، فيجب أن تتوفر لهم الضمانات التي تكفل حمايتهم، وتحقق استقلالهم وتضمن حيدتهم في إصدار أحكامهم حتى يكونوا آمنين في حاضرهم مطمئنين على مستقبلهم، ونظراً لأهمية توافر الحماية بالنسبة للقاضي وأتصافه بالنزاهة والحيدة، فهذا سبب اختياري لموضوع هذا البحث، وعنونته بعنوان: "حماية القاضي وضمانات نزاهته - دراسة مقارنة بين الفقه الإسلامي وقانون المرافعات المدنية"
بعون الله تعالى وتوفيقه أتناول هذا الموضوع في فصل تمهيدي وبابيين وخاتمة؛ أما الفصل التمهيدي فهو بعنوان: "التعريف بالقضاء وأهميته العملية وحكم توليه" ، وأما البابيين فيشتملان على الباب الأول: "حماية القاضي في الفقه الإسلامي والقانون الوضعي" ويشتمل على ثلاثة فصول هما: ((الفصل الأول: حماية القاضي من السلطات، الفصل الثاني: حماية القاضي من الخصوم في الفقه الإسلامي والقانون الوضعي، الفصل الثالث: حماية القاضي من نفسه في الفقه الإسلامي والقانون الوضعي)) ، أما الباب الثاني: "ضمانات نزاهة القاضي في الفقه الإسلامي والقانون الوضعي" ويشتمل أيضاً على ثلاثة فصول: ((الفصل الأول: المبادئ التي تقوم عليها نزاهة القاضي في الفقه الإسلامي، الفصل الثاني: كيفية تحقق ضمانات نزاهة القاضي، الفصل الثالث: الآداب والواجبات التي يجب أن يتحلى بها القاضي))
