أصبح العرف السلطة المتأصلة في ضمير الجماعة، وهو قوة تحتوي على عنصري الإيمان والعاطفة، إذْ إنهُ يجمع بين شعور الجماعة وتوافقها المشترك ويساهم في ضبط وتنظيم سلوكها؛ ولأهمية العرف في الحياة فقد عده الفقهاء والعلماء بمثابة الجذر الحقيقي لمجموعة الشرائع والقوانين التي أنتجتها البشرية على مر العصور، وعدته الشريعة الإسلامية السمحاء دليلاً من أدلتها الشرعية بشرط أن لا يخالف دليلاً شرعياً أو قاعدة من قواعدها.
وللإعتبارات السابقة وللأهمية التاريخية والشرعية والقانونية للعرف، ولدوره في تاريخ وتراث الأمة، ولأهميته في صياغة كثير من القواعد الفقهية والقانونية، جاءت هذه الرسالة بعنوان "الجذور التاريخية للعرف وأثره في الشريعة الإسلامية والقانون الوضعي".
ولقد اقتضت طبيعة الدراسة أن تكون في أربعة فصول، كل فصل منها بثلاثة مباحث، وفق ما يأتي: الفصل الأول: "العرف في القوانين والتشريعات القديمة"، الفصل الثاني: "العرف عند العرب قبل الإسلام"، الفصل الثالث: "أثر العرف في الشريعة الإسلامية"، الفصل الرابع: "أثر العرف في القانون الوضعي".
