لا نجد شريعة من الشرائع السماوية أو قانوناً من القوانين الوضعية أوليا للحيوان حقوقاً على الإنسان مثلما فعلت الشريعة الإسلامية وهذا وإن دل على شئ فإنما يدل على عظم وتكامل الشريعة الإسلامية، وإذا كان الإنسان ينتفع بالحيوان في جملته وله حقوق عليه، فعليه هو الآخر أن يراعي حقوق الحيوان نحوه، وفي مقدمتها الرحمة به وحسن المعاملة له، وكما سنتحدث فيما بعد.
ومن ثم أيضاً فإنه من خلال هذا البحث سوف نعطي لمحة عن حقوق الحيوان على الإنسان من خلال منهج الشريعة الإسلامية، والتي لو وضعها كل إنسان نصب عينيه وراعها لما احتجنا إلى جمعيات الرفق بالحيوان التي أنشئت لهذا الغرض، متبعين ذلك بما ورد في الطلب والقانون بخصوص هذا الموضوع، وقد قسمت هذا البحث إلى تمهيد وأربعة فصول هي: (الفصل الأول: أحقية الإنسان بالإنتفاع بالحيوان في الشريعة الإسلامية والرأي الطبي والقانوني في ذلك، الفصل الثاني: الحقوق العامة للحيوان في الشريعة الإسلامية والموقف القانوني منها، الفصل الثالث: الحقوق الخاصة بالحيوان المركوب، الفصل الرابع: الحقوق الخاصة بالحيوان مأكول اللحم) وخاتمة.
