تقسم هذه الدراسة إلى ثلاثة أبواب رئيسية، الباب الأول وهو فى الأحكام العامة لجرائم المعلوماتية وسنقيمه على ثلاثة فصول. فى الفصل الأول منه سنعرض لتطور المعلومات وأوعية التدوين الخاصة بها. ثم نعرض فى الفصل الثانى لتعريف المعلومات والمعلوماتية والنتائج القانونية المترتبة على ذلك. أما الفصل الثالث فنكرسه لتعريف الجرائم المعلوماتية والخلاف الفقهى بخصوصها، والتعريف المقترح وسماته الجوهرية. وسوف نخلص من هذا التعريف المقترح إلى أن الجرائم المعلوماتية تنقسم- فى تقديرنا- إلى نوعين: جرائم معلوماتية. ونعنى بها تلك التى يكون محلها حقوق أو مصالح تقليدية كان يحميها قانون العقوبات بهذا المفهوم ثم طرأ عليها متغير جديد هو ارتكابها بوسيلة ذكية هى النظم المعلوماتية ومثال ذلك الاحتيال التقليدى والاحتيال المعلوماتى، السرقة التقيليدية والسرقة المعلوماتية، التزوير التقليدى والتزوير المعلوماتى، القتل التقليدى والقتل المعلوماتى وهكذا. وهذه النوعية من الجرائم سنتعرض لها فى الباب الثانى وهو فى النيان القانونى لجرائم المعلوماتية فى صورتها التقليدية، ويضم: - الجرائم المعلوماتية الماسة بالأموال: كالسرقة المعلوماتية، النصب أو الاحتيال المعلوماتى. كما أن هناك نوعاً آخر من جرائم المعلوماتية يمكن أن نسميه الجرائم المعلوماتية المستحدثة. وهذه النوعية من الجرائم تضم جوهر جرائم المعلوماتية - كما تقول اتفاقية بودابست - وهى الجرائم التى تعرف بالجرائم ضد سرية البيانات والنظم وإتاحة البيانات والنظم. وهى تمثل التهديدات الرئيسية - وفقاً للمناقشات التى دارت حول أمن الحاسبات والبيانات - التى تؤثر على نظم المعالجة الألية وإرسال البيانات. ويمكن بلورة هذه النوعية من الجرائم فى طائفتين: الولوج غير المصرح به، والإتلاف غير المشروع للنظم أو البرامج أو البيانات. وهذه المفردات جميعها هى موضوع الباب الثالث والأخير من هذا الكتاب وهو البنيان القانونى لجرائم المعلوماتية فى صورتها المستحدثة.
