لما كان المشرع التأميني قد اعتبر الهيئة الإجتماعية القائمة على تنفيذ هذا القانون هيئة عامة ومن ثم اعتبر أموالها "أموال عامة" وخول لها سلطة المحافظة على هذا المال بأن حعل له حق الإمتياز وإمكان اتباع الحجز الإداري ومن إتباع إجراءات التقاضي العادية فكان من الطبيعي أن تنشأ في علاقة الهيئة بالمستفيد أو صاحب العمل منازعات، وسوف يقتصر هذا البحث على المنازعات التي تسوى بالطرق المدنية والتي تخضع لنظام التحكيم قبل اللجوء إلى إجراءات التقاضي. وعندئذ يتضح جلياً حقيقة هذه المشكلة التي سوف نعالجها والتي نركز على العلاقات الثلاثية المشار إليها، ويرتكز البحث هنا على المنازعات المدنية فقط وسوف نعرضها فيما يلي: ( الفصل الأول: منازعات خاصة بالمستفيدين- وسوف نقسم هذا الفصل إلى مبحث أول الحقوق والتعويضات المستحقة للمستفيدين من أحكام هذا القانون ومدى تأثرها بالمؤثرات التشريعية والمبحث الثاني: المطالبة بهذه الحقوق وضمان الوفاء بها والمبحث الثالث: النظام القانوني لفض المنازعات الخاصة بالمستحقات المذكورة، الفصل الثاني: منازعات خاصة بأصحاب الأعمال. ويخصص لها مبحث أول: الأداءات التي يلتزم بها صاحبة العمل. المبحث الثاني: طرق فض المنازعات الخاصة بالإشتراكات، الفصل الثالث: منازعات خاصة بهيئة التأمينات الإجتماعية. ويخصص لها مبحث أول: حالة التخلف أو التأخير عن أداء الإشتراك والنطاق الزمني للمطالبة بحقوق الدائنية المبحث الثاني: الحماية التشريعية لحقوق الهيئة).
