تلاحظ في هذه الآونة الحاضرة من الآلفية الثالثة تزايد ظاهر الشقق للتمليك وليس للإيجار وأصبحت غالبية هذه العقارات مقسمة إلى طبقات وشقق يطلق عليها الملكية المشتركة وأصبح ملاك هذه الشقق والطبقات لا يقومون بالعناية الواجبة نحو هذه الثروة العقارية بما يقلل من إطاعة عمر هذه العقارات.
وبالتالي ضعف الثروة العقارية التي تعد العمود الفقري للاقتصاد القومي ونظراً لأن القواعد التشريعية الواردة في القانون المدني وقانون إيجار الأماكن أصبحت غير كافية وغير مناسبة لحماية هذه الثروة العقارية فقد تنبه المشرع المصري إلى هذه الخطورة الراهنة التي تواجهها هذه الثروة العقارية فسارع إلى إصدار تشريع حديث تحت رقم 119 لسنة 2008.
ونظراً لأهمية هذا الموضوع من حيث الواقع التطبيقي وحداثة النصوص قمنا بالتعرض لاتحادات الملاك وصيانة الثروة العقارية في مصر بعيداً عن الخلافات الفقهية وسوف نتولى في هذا البحث سبر أغوار الملكية المشتركة ومزاياها وعيوبها والنظام القانوني لحماية هذه الثروة العقارية سواء في ظل القواعد العامة الواردة في القانون المدني أو في التشريع الخاص 119 لسنة 2008 كما يلي: الفرع الأول: الملكية المشتركة في القانون المدني, الفرع الثاني: اتحادات الشاغلين وصيانة الثروة العقارية في مصر.
