لقد آثرنا أن يكون موضوع دراستنا في هذا البحث المتواضع هو الاتجاهات الحديثة في إعادة التامين لإلقاء الضوء على هذا النشاط وتطوراته، والذي لم يلق من البحوث والدراسات القانونية ما يتلاءم مع أهميته ودوره في صناعة التامين بوجه عام، يتميز نشاط إعادة التامين بتعدد وتنوع الطرق والأشكال القانونية لعقود واتفاقات الإعادة المبرمة بين المؤمنين المباشرين والمؤمنين المعيدين، فهناك ما يعرف باتفاقات إعادة التامين الاختيارية، واتفاقات الإعادة الإجبارية، واتفاقات الإعادة المختلطة، والواقع إننا سنتعرض لكافة تلك الاتفاقات وتسمياتها بالتحليل والنقد مع بيان رأينا الخاص فيها، والتقسيم والتسمية المقترحة.
ونشير في هذا الصدد إلى إننا سنقتصر على عرض ودراسة الصور والأشكال القانونية لاتفاقات الإعادة، أما فيما يتعلق بالطرق الفنية المتنوعة لإعادة التامين، والتي تعكس أشكال مساهمة المؤمن المعيد في تحمل المخاطر مع المؤمن المباشر، كإعادة التأمين بالمحاصة، وإعادة التأمين فيما يجاوز حدا من الخسائر، وإعادة التأمين فيما يجاوز حداً من الطاقة، وغيرها، فستخرج عن نطاق دراستنا القانونية البحتة، وسنحيل بشأنها إلى المراجع المتخصصة التي تناولتها من الوجهة الفنية والإحصائية على النحو الذي سنبينه في موضعه.
وأخيراً سنختتم دراستنا ببيان الآثار القانونية المترتبة على اتفاقات إعادة التامين، أما في الفصل الثاني فسنعرض لاتفاقات وعقود إعادة التامين من حيث صورها وأشكالها القانونية، مختتمين ذلك ببيان الآثار الناشئة عنها، وذلك على ما يلي: الفصل الأول: ماهية إعادة التامين، الفصل الثاني: اتفاقات إعادة التامين وآثارها.
