لقد آثرنا أن تكون دراستنا لموضوع البحث مقارنة بين القانون المصري والقانون الفرنسي وقانون اليونسترال. فمن ناحية أولى: فإن المقارنة بين القانون المصري والقانون الفرنسي أمر تبرره الأواصر التاريخية والثقافية التي تربط بين هذا وذاك، وهو أمر مسلم في الفقه القانوني المصري.
ومن ناحية ثانية: فإن إدخال قانون اليونسترال طرفاً في المقارنة، فإنما يبرره أولاً.. تزايد الإتجاه إلى تدويل العقود الإدارية، ولاسيما بعد نفاذ الإتفاقيات الدولية التي تسعى إلى تحرير التجارة الدولية بين جمع الدول (مثل إتفاقية الجات). وثانياً.. فإنه على المستوى المحلي أصبحت القوانين التي تضعها لجان الأمم المتحدة منهلاً أساسياً للتشريع في أغلب الدول ومنها مصر بطبيعة الحال، وقد إلتزمنا في بحثنا خطة تقوم على تقسيم موضوعه إلى فصلين على النحو التالي:
الفصل الأول: نتناول فيه المبدأ التقليدي في التقدم للمناقصة العامة "حرية الدخول". وقسمنا هذا الفصل إلى ثلاثة مباحث: نتناول في الأول منهم. مفهوم مبدأ حرية المنافسة وحدوده كإطار حاكم لمبدأ حرية الدخول في المناقصة. أما المبحث الثاني: فقد خصصناه لبحث موضوع وضع مبدأ حرية المنافسة موضوع التطبيق. وأخيراً المبحث الثالث: فقد بحثنا فيه حرية التقدم بالعطاء ومدى سلطة الإدارة في قبوله.
الفصل الثاني: تناولنا فيه إسناد التعاقد عن طريق المناقصة. وقسمناه بدوره إلى ثلاثة مباحث: تناولنا في المبحث الأول: المبدأ التقليدي في الإسناد "الإسناد بمقتضى السعر الأقل" وفي المبحث الثاني: بحثنا كيفية الإسناد بمقتضى السعر الأقل. واخيراً كان المبحث الثالث: مخصصاً لبيان التطور الحديث على المبدأ التقليدي في الإسناد بمقتضى السعر الأقل.
