تكمن أهمية دراستنا هذه في أهمية الموضوع الذي تتناوله بالذات، فالجرائم المعلوماتية كانت وما زالت موضع إهتمام العديد من المؤتمرات والإتفاقيات الدولية والإقليمية، كما وأنها أصبحت اليوم الشغل الشاغل لفكر العديد من فقهاء القانون الجنائي، ومن ثم فقد أتت هذه الدراسة لتسلط الضوء على جانب مهم من جوانب مكافحة الجرائم المعلوماتية الذي كان وما زال مثار جدل، ويتناول هذا البحث الإشكاللات القانونية والفنية للتحقيق الإبتدائي في الجرائم المعلوماتية، ونقصد بالتحقيق الإبتدائي هنا التحقيق بمعناه الواسع الذي يشمل كافة الإجراءات التي تتخذها كل من سلطات الإستدلال والتحقيق بخصوص هذه الجرائم، على أننا لن نتناول بالبحث إلا تلك الإجراءات التي تثير الإشكالية مجال التحقيق في الجرائم المعلوماتية.
وفي ضوء كل ما تقدم سنبحث المشاكل القانونية والفنية للتحقيق في الجرائم المعلوماتية في ثلاثة فصول، نبين في الأول منها البطاقة التعريفية للجرائم المعلوماتية، فيما نبحث في الثاني الإشكالات التي تعتري سبيل إكتشاف هذه الجرائم وتلك التي تعترض تحريك دعواها الجزائية وتحديد الإختصاص بالتحقيق فيها، ونسلط الضوء في الثالث على المشاكل المتعلقة بإجراءات جمع الأدلة في هذه الجرائم، وختامًا سننهي دراستنا هذه بخاتمة تتضمن ما نتوصل إليه من إستنتاجات وتوصيات.
