لسنا في حاجة للحديث عن أزمة الإسكان الطاحنة التي حدت بالمشرع إلى الخروج عن القواعد الواردة بالقانون المدني التي تنظم العلاقة بين المؤجر والمستأجر على نحو يتفق مع المبادئ العامة، بوضعه تشريعات استثنائية ذات طبيعة آمرة لتقيم التوازن الإجتماعى بين الطبقتين ومحاولة منه لتفادى الآثار السيئة التى تنجم عن أزمة الإسكان المتفاقمة.
تزداد أهمية أحكام القانون المدني المنظمة للإيجار أمام أزدهار النشاط الإيجارى فى مجال الحرف والمهن حيث يوفر التأجير المكان المناسب والأدوات والآلات اللازمة لممارسة تلك الأنشطة. وبدأ إيجار المنقول يحتل مكانة هامة فى الانشطة الاستهلاكية (كتأجير السيارات والأجهزة المعمرة...) والإنتاجية، وظهرت أنظمة قانونية متطورة لمواجهة ذلك مثل التأجير التمويلي وإيجار الخدمات لتوفير التجهيزات المهنية ذات التقنية العالية مثل أجهزة الحاسب الآلى ومعدات الإنتاج والمقالات.
يتضح من ذلك أن العلاقات الإيجارية يخضع بعضها لأحكام القانون المدني ويخضع البعض الآخر لأحكام قانون إيجار الأماكن، وهذا ما تعرض له في كل من قسمي الكتاب على التوالي. ونستهل تلك الدراسة بفصل تمهيدي نبين فيه مفهوم الإيجار ونظامه القانوني.
