إذا كانت قواعد القانون الدولي الاجتماعي- كفرع من فروع القانون الدولي العام- هي تلك القواعد الدولية التي تعني بتنظيم أمور ذات طبيعة اجتماعية بحتة مثل مكافحة الجريمة، فإنه يتداعى منطقيًا السؤال الآتي: هل توجد قواعد دولية تستهدف مكافحة الجرائم ذات الطبيعة الدولية بما يقال في فقه القانون الدولي العام من وجود قانوني دولي للعمل، وقانون دولي صحي، وإذا افترضنا أن الرد سيكون بالإيجاب، فإنه تداعى- منطقيًا- تساؤلات عدة تدور حول دور الجماعة الدولية في وضع تلك القواعد، ودورها في تطبيق هذه القواعد، وكيفية ذلك.
وهذا الأساس سوف نقسم الدراسة إلى مقدمة: نخصصها للتعريف بالجريمة ذات الطبيعة الدولية، باب تمهيدي: نتناول فيه- بالقدر الذي يغطي جوانب الدراسة- النظرية العامة للقانون الدولي الاجتماعي، قسم أول: ونتناول فيه دور الجماعة الدولية في وضع القواعد الدولية المستهدفة مكافحة الجرائم ذات الطبيعة الدولية، قسم ثاني: نتناول فيه دور هذه الجماعة في تطبيق تلك القواعد، خاتمة نخصصها للإجابة على السؤال الذي طرحناه، والذي يدور حول وجود أو عدم وجود قواعد دولية- قانون دولي- لمكافحة الجرائم ذات الطبيعة الدولية.
