تمثل «خلافة الدول» ظاهرة معقدة وذات أثر كبير بالنسبة إلى استقرار المراكز القانونية في المجتمع الدولي. فحلول دولة محل أخرى في المسؤولية عن العلاقات الدولية لإقليم معين يحمل في طياته تبدلات قانونية واسعة الأثر، كما أنه قد يؤدي إلى نشوء نزاعات بين الدول المعنية بالخلافة. وإذا كان القانون الدولي قد نظَّم بعض الموضوعات والجوانب الناشئة عن خلافة الدول بمقتضى اتفاقيات دولية مخصصة لهذه الغاية، فإن معظم تلك القواعد تعد «قواعد مفسِّرة» يتم اللجوء إليها عند غياب الاتفاق بين الأطراف المعنية؛ فالأصل في تسوية النزاعات المتعلقة بخلافة الدول خضوعها لسلطان إرادة الدول المعبَّر عنه باتفاق بين الدول المعنية، يجري التوصل إليه بعد مفاوضات فيما بينها. يعالج هذا البحث الموضوعات المتصلة بخلافة الدول، من خلال دراسة عناصر ومكونات التسوية الاتفاقية للنزاعات الناشئة عنها، وخاصة الأسس القانونية والعملية التي تفرض مثل هذه التسويات، والقيود المفروضة على إرادة الدول في تسويتها للأوضاع الناشئة عن هذه الخلافة، وخاصة تلك المتعلقة بحقوق الإنسان وبحقوق الأقليات.
