ليست الجريمة ظاهرة مادية خالصة قوامها الفعل وآثاره، ولكنها كذلك كيان نفسي؛ ومن ثم استقر في القانون الجنائي الحديث ذلك المبدأ الذي يقضي بأن ماديات الجريمة لا تنشيء مسئولية ولا تستوجب عقاباً، ما لم تتوافر إلى جانبها العناصر النفسية التي يتطلبها كيان الجريمة. وتجتمع هذه العناصر في ركن يختص بها ويحمل اسم "الركن المعنوي للجريمة". وليس هذا الركن قديماً قدم القانون الجنائي نفسه، فالجريمة قد عرفت وعاقبت عليها التشريعات القديمة قبل أن يعترف الشارع للركن المعنوي بأهميته القانونية، فكان العقاب على الفعل وآثاره، دون اعتبار لنصيب الإرادة في استكمال الجريمة مقوماتها. ولكن هذا الوضع لم يكن له أن يستمر، ذلك أن مبادئ الأخلاق وتعاليم الأديان، وما صاحب ذلك من تقدم علمي، كل ذلك قد أثبت تناقض فكرة المسئولية المادية ونظام العقوبة ذاته.
والقصد الجنائي ظاهرة نفسية، ولهذه الظاهرة عناصرها ومقوماتها، ودراسة هذه العناصر هي أهم موضوعات البحث في النظرية العامة للقصد الجنائي. وأهمية هذه الدراسة كبيرة: فهي تحليل لفكرة القصد الجنائي وتأصيل لأحكامها. وتحديد عناصر القصد الجنائي موضوع الخلاف الفقهي، فإذا كان الاجماع منعقدا على أن القصد الجنائي "علم واردة"، أي أنه يقوم على عنصرين: العلم والإرادة، فإن الخلاف يثور حول تحديد أهمية كل منهما بالنسبة للآخر، وما إذا كان لهما ذات الأهمية والنطاق بالنسبة لأركان الجريمة وعناصر كل ركن.
وعلى هذا سوف يتضمن هذا المؤلف الأبواب التالية:
الباب الأول: الخلاف الفقهي حول تحديد عناصر القصد الجنائي.
الباب الثاني: العلم.
