إن موضوع الدراسة هو- في المقام الأول- المساهمة الجنائية في التشريعات العربية. وتتجه هذه الدراسة إلى البحث في أركان المساهمة الجنائية، وتجتهد بعد ذلك في تحديد الفروق التي تميز بين طوائف المساهمين في الجريمة واستقراء الأحكام الخاصة بكل طائفة منها. ولكن الدراسة المقارنة للتشريعات العربية لا تكتمل صورتها بغير دراسة بعض التشريعات الأوربية التي تتصل بالتشريعات العربية أو تقترب منها أو تعين على فهم أحكامها، ونشير بصفة خاصة إلى قانون العقوبات الفرنسي وقانون العقوبات الألماني وقانون العقوبات الإيطالي.
وتتضمن الدراسة كذلك مشروع قانون العقوبات الفرنسي الذي أعد سنة 1985، لما يمثله من اتجاهات تشريعية حديثة ذات سند من الفقه الفرنسي الحديث وتوصيات المؤتمرات الدولية. وتتضمن الدراسة كذلك البحث في توصيات مؤتمر اثينا الدولي الذي عقد في عام 1957 لما تمثله من قيمة علمية، وما تبرزه من اتجاهات مقارنة في الفقه الحديث. ولن تكون هذه الدراسة مجرد تفسير وشرح لنصوص هذه التشريعات، وإنما هي دراسة مقارنة بينها، تدخل في نطاق القانون الجنائي المقارن.
