علم العقاب هو مجموعة من القواعد تحدد الأصول الواجبة الاتباع كي يكون تنفيذ العقوبات والتدابير الاحترازية محققًا الأغراض الاجتماعية التي من أجلها تقررها التشريعات الجنائية. ويعني ذلك أن أول ما يبحث فيه علم العقاب هو تحديد الأغراض الاجتماعية التي يستهدفها نظاما العقوبات والتدابير الاحترازية. ولا ينظر علم العقاب إليهما من زاوية تشريع معين، وإنما يبحث فيهما باعتبارهما نظامين اجتماعيين يقتضيهما نظام المجتمع وتفرضهما الحاجة إلى مكافحة الجريمة. ويجتهد علم العقاب بعد ذلك في استخلاص القواعد التي تجعل تنفيذ العقوبات والتدابير الاحترازية محققًا أغراضه الاجتماعية على النحو الصحيح، أي أنها تتجه إلى تحقيق الاتساق والتوازن بين حاجات المجتمع وأسلوب تنفيذ العقوبات والتدابير الاحترازية.
وسوف نعرض فيما يلي لتطور القانون الجنائي بالقدر الضروري لتوضيح وضعه ومعالمه في الوقت الحاضر، وتشمل هذه الدراسة تطور القانون الجنائي في ذاته، كما تشمل تطور الفقه والدراسات الجنائية.
ونرى تقسيم هذه الدراسة إلى قسمين: قسم نخصصه لتطور القانون الجنائي في العهود السابقة على الثورة الفرنسية، وقسم نخصصه لتطوره في عهد هذه الثورة والعهود اللاحقة عليه. يليه القسم الأول من الكتاب: النظرية العامة للجريمة وفيه من الأبواب، ثم القسم الثاني: النظرية العامة للعقوبة والتدبير الاحترازي وفيه من الأبواب: (الباب الأول: النظرية العامة للعقوبة، الباب الثاني: النظرية العامة للتدبير الاحترازي).
