إن هذه الدراسة المتواضعة ستحاول بناء نظرية عامة يستقيم بها تسبيب الحكم الجنائي في مرحله المختلفة، تجمع شتات هذه الموضوع المتناثر في كافة موضوعات القانون الجنائي، بما يترتب عليه في النهاية صحة التسبيب وحماية الحكم الجنائي من نقصه سواء أكان ذلك لإنعدام الأسباب أم لقصورها أم للفساد في الإستدلال.
وترتكز أول دعائم هذه النظرية على تحديد طبيعة الإلتزام بالتسبيب، لما لهذه الطبيعة من أهمية في الكشف عن حقيقته، ومن ثم تحديد نطاقه فيما يتعلق بالأسباب واجبة البيان في الحكم الجنائي، وكذا الأحكام الجنائية التي تخضع لهذا الألتزام وتكون واجبة التسبيب.
وتأتي ثانية دعائم هذه النظرية في بيان القواعد التي من شأن السير على هداها ضمان صحة الإقتناع الموضوعى لقاضى الموضوع من حيث مضمونه ومنهج الوصول إليه، والتي تكفل أيضاً التسطير الكافي والسائخ لهذا الإقتناع في الأسباب الواقعية للحكم الجنائي، وذلك في أسلوب قضائى صحيح، بحيث تأتي معبرة عنه خير تعبير سواء من حيث الواقع أو من حيث التطبيق الصحيح للقانون.
ونختتم دعائم هذه النظرية ببيان الأثر المترتب على مخالفة قواعد التسبيب سواء أكان ذلك لإنعدام الأسباب أم لقصور التسبيب أم للفساد في الإستدلال، من هنا فقد يكون من الملائم تناول موضوع هذه الدراسة على النحو التالي:
القسم الأول طبيعة التسبيب ونطاق الإلتزام به "الباب الأول طبيعة التسبيب، الباب الثاني نطاق الإلتزام بالتسبيب.
القسم الثاني قواعد التسبيب وأثر مخالفتها "الباب الأول قواعد التسبيب، الباب الثاني أثر مخالفة قواعد التسبيب".
