وفي هذه الدراسة سوف نقوم ببحث نظام الأمر الجنائي من خلال أربعة فصول، على أن نسبق ذلك بفصل تمهيدي. وقد خصصنا الفصل التمهيدي لبحث التطور التاريخي الذي لحق بنظام الأمر الجنائي في التشريع المصري والفرنسي، في حين خصصنا الفصل الأول لبحث موضوع طبيعة الأمر الجنائي، وخصصنا الفصل الثاني لبحث موضوع الدعوى المدنية التبعية والأمر الجنائي، وخصصنا الفصل الثالث لبحث الأحكام التشريعية والفقهية لنظام الأمر الجنائي في التشريعين المصري والفرنسي، وأخيرًا خصصنا الفصل الرابع والأخير لبحث نظام الأمر الجنائي في الشريعة الإسلامية، متبعين في ذلك منهج الطريقة الاستقرائية التحليلية، معضدين ذلك بالدراسة المقارنة ولا سيما مع التشريع الفرنسي.
