لقد تكفل الدستور المصري الدائم في الباب الثالث منه الخاص بالحريات والحقوق والواجبات العامة بدءاً من المادة 40 وانتهاء بالمادة 63 منه على بيان القواعد العامة تاركاً للقانون وضع التفسير والتوضيح الملائم لكل مادة منها. وبيت القصيد ها في موضوع البحث هو المادة 62 من الدستور ولقد وضع المشرع المصري ضمانات وضوابط تهدف إلى توفير الحماية القانونية اللازمة لضمان سير وسلامة العملية الانتخابية وهو القانون رقم 73 لسنة 1956 وتعديلاته، والتي سوف نتناول من خلالها الجرائم الانتخابية للمرشح في ضوء الانتخابات البرلمانية النيابية.
ولما كان بيت القصيد في هذا البحث هو المرشح وجدنا إنه من المناسب أن نتعرض لمشكلة إزدواج الجنسية للمرشح ومشكلة تغير الصفه أو الانتماء الحزبي للمرشح وأيضاً مشكلة نواب التجنيد أو التهرب من أداء الخدمة العسكرية بإعتبارهم جرائم تخل بالعلاقة التعاقدية بين الناخب والنائب وأخيراً نواب الرزيلة، ولسوف نتولى مزج تلك الدراسة من خلال بحثنا بين النظامين الفرنسي والمصرى.
ويمكن لنا تقسيم الجرائم والمشاكل الانتخابية للمرشح إلى قسمين أساسين الأول وهو الخاص بالجرائم المتعلقة بالدعاية السياسية للمرشح، والثاني وهو الخاص بالمشاكل الانتخابية المتعلقة بشخص المرشح والتي تظهر عقب فوزه في الانتخابات واكتسابه العضوية.
