لا يخفى ما للعقد من موضوعية بالغة الأثر في الحياة الإجتماعية لذا أخذ الفقه والقانون فيما بعد على عاتقهما تنظيم علاقات الأفراد فيما يخص الأموال التي يكون مصدرها العقد إلا أن الفقه الإسلامي لم يكن بصدد تبويب مسائل العقد في حيز محدود يسهل تناوله وإنما كانت مسائله يجمعها حيز الموضوع تارة وتارة أخرى حيز الغاية لذا كان الأمر سهلاً في هذا المجال.
ولما كانت مسائل العقد معقدة في ذاتها مشتتة في الجانب الفقهي ارتأينا بحثها بموضوعية في كتاب مستقل وذلك بتسليط الضوء على مسألة تكوين العقد وإنشائه وأرجأنا البحث عن أحكامه في كتاب لاحق إن شاء الله تعالى وبعونه.
وحيث لم يتعرض أعلام الفقه الإسلامي خلافاً لأرباب القانون إلى نظرية تكوين العقد بشكل مستقل وضمن حيز محدود.
الأمر الذي جعلنا نسلط الضوء على أهم القواعد الأساسية في تكوين العقد وبيان الأسس والأركان التي يتقوم بها مما يجعله عرضة لجملة من الأحكام بنظر الجانبين الفقهي والقانوني.
وهذا ما رمنا الخوض فيه بصورة لم يسبقنا إليها أحد حسب مطالعاتي القاصرة.
حيث المقارنة بين الفقه الإمامي الذي ضنت به ساحة البحوث القانونية العلمية إضافة إلى بيان مدى العمق الفكري الذي يتسم به هذا الفقه وصولاً إلى أهم النتائج التي تصلح أن تكون تعديلاً او توضيحاً لمواد القانون المدني آخذين بنظر الإعتبار الدراسة المقارنة مع القوانين الأخرى غير قانون الباحث (القانون العراقي) والتي لم يكن لها حصة الأسدى في البحوث القانونية كما هو الحال في التقنين الإيراني.
