لقد شرّع الله الزواج وجعل له أركاناً وشرائط ينبغي توافرها لتحقيق المقصد الذي شرع الزواج من أجله، وكما شرع الشارع الكريم طرقاً متعددة لحل عقد النكاح فقد أجاز فسخ عقد النكاح أصلاً وحدد أسباب ذلك.
وقد تناول هذا الكتاب موضوع فسخ عقد النكاح لما هذا الموضوع من أهمية فائقة في مجال القضاء ولكون كثير من قوانين الدول الإسلامية أهملت جوانب كثيرة من الأسباب التي من شأنها أن توجب أو تجيز فسخ عقد النكاح.
وقد جاء هذا البحث في مقدمة وثلاثة فصول جعل الفصل الأول منها لبيان التعريفات الأساسية، وبيان الآثار المترتبة على فسخ العقد. أما الفصل الثاني فقد خصص للأسباب غير الإرادية لفسخ العقد. وأما الفصل الثالث فقد خصص للأسباب الإرادية لفسخ عقد الزواج. ثم ختم البحث بخاتمة بيّنت أهم النتائج وألحقت ببعض التوصيات.
