ينبني قانون المعاملات المدنية لدولة الإمارات المنهج الموضوعي للمسئولية وهو المنهج الذي سارت عليه أحكام الشريعة الإسلامية وهي تقرر مسئولية كل من أحدث الفعل الضار حتى ولو كان غير مميز، لأن الهدف من تقرير هذه المسئولية هو جبر الأضرار، وأن تطبيق فكرة المسئولية المبنية على أساس الخطأ - والتي يأخذ بها المذهب الشخصي والقوانين التي سارت على نهجه كالقانون المدني المصري - تؤدى إلى الوصول للقول بعدم مسئولية الصغير والمجنوب بسبب عدم إمكانية نسبة الخطأ إليهما مما يترتب عليه حرمان المضرورة من التعويض مما أدى لبحث المشرعين عن حل لهذه المشكلة فوجدوها في إبتكار مسئولية متولي الرقابة.
وهذا يستوجب منا أن نبحث مبررات إنشاء قانون المعاملات المدنية لهذا النوع من المسئولية المفترضة ومدى الحاجة للجوء إليها، وما إذا كانت قواعد المسئولية الموضوعية التي يسير عليها قانون المعاملات كافية بذاتها أم لا لجبر الأضرار.
