خلق الله تعالى الإنسان وسنّ له قوانين تنظم له أموره مع خالقه تعالى، وتنظم أموره في تعامله مع الآخرين وضبطها بمعيار شرعي كما أراد الله سبحانه إلا أن الإنسان طُبع على الجهل والتمرد والخروج عن شرعة الله عزّ وجلّ.
فيعمل في الغالب بنظرة قصيرة بهدف جمع المال - وهو تاركه فيحتال على شرع الله سبحانه وتعالى فيخطئ ويستحق بذنبه العقاب في الدنيا والآخرة.
ومن رحمة الله سبحانه وتعالى بمن خلق من البر أنه يهيئ لهم علماء من بينهم ورثة للأنبياء يعُلّمون الناس أمور دينهم، ويجتهدون فيما لا نص فيه، ويستخلصون الأحكام المعتمدة على العلة المنضبطة للوصول إلى الحكم الأكثر ملاءمة لمصالح العباد، فينظمون العقود المتعددة بأركان وشروط، فتصبح عقوداً مسماة، ومن هذه المعاملات مستجدة لتلبي حاجة الإنسان ويحتاج إلى ضبط أركانه وشروطه وإعطائه اسم ليصبح مسمى، وهذا ما يبحثه هذا الكتاب.
