إن نظام الحكم في الإسلام او ما يطلق عليه فقهاء الشريعة السياسة الشرعية هي: تدبير الشؤون العامة للدولة الإسلامية بما يكفل تحقيق المصالح ورفع المضار فيما لا يتعدى حدود الشريعة وأصولها الكلية.
فالنظام الإسلامي يقصد به النظام الذي يتفق مع ما ورد في القرآن الكريم وسنّة النبي محمد صلى الله عليه وسلم، وهذا النظام طبق في عهد النبي صلى الله عليه وسلم، وفي عهد الخلفاء الراشدين، ولا يقدح في هذا النظام أن بعض حكام الدولتين الأموية والعباسية والدول والإمارات التي أعقبتها قد خرجوا على بعض القواعد الأساسية للنظام الإسلامي.
وللنظام الإسلامي خصائص وميزات تجعله صالحاً لكل زمان ومكان، فقرر الإسلام الحقوق والحريات العامة للأفراد، ولم يكتف الإسلام بتقرير هذه الحقوق بل نظم أمور الحكم في القرآن الكريم، ولم يجعل للحاكم سلطة مطلقة بل قيدها وحددها، وإختيار الحاكم لا يكون بالتعيين ولا يوجد نص يبين كيف يتم إختياره، إنما يكون بالبيعة العامة، بعد أن يختار من أهل الحل والعقد، ممن تتوفر بهم شروط الإمامة، وهذا ما تم بحثه في هذا الكتاب.
حيث يبين فيه المؤلف الشروط الواجب توفرها في الحكام المسلم وطرق الإختيار والبيعة ونظام الشورى، وحقوق المواطن المسلم وغير المسلم في الدولة الإسلامية، والسلطة التنفيذية ونظام الحكم والقضاء بأنواع المحاكم بما يختص النظر بأمور الرعية المتنوعة ومحكمة المظالم المختصة بالنظر في أمور موظفي الدولة، وكذلك إتخاذ القرار السياسي من السلطة الحاكمة مروراً بأهل الحل والعقد، ونظام المساواة أمام القانون وأمام التكاليف والوظائف، ومبيناً حق إبداء الرأي وأسس ذلك طبيعياً وقانونياً ونفعياً وغاية الحرية العامة، وموقف الشريعة الإسلامية من حق مقاومة الطغيان ومبدأ الشورى ومدى إلزاميته للخليفة، ومبدأ التسامح بين المسلمين ومع غير المسلمين.
