هذا الكتاب عبارة عن دعوة علمية ورسالة منهجية موجهة إلى الأمة الإسلامية بغية إعادة التفكير في مركزية وأهمية فقه الواقع في مجال بناء الرؤية الحضارية وهو موضوع استدبره المستدبرون واستقبله المستقبلون على نحو من الإخلال بماهيته وبمواطن إستحضاره والعمل به؛ إما من جهة الجهل به أو بآلياته.
وهي محاولة للكشف عن ماهية هذا الموضوع في ضوء مقولة تأثر الفقه بالواقع وتأثيره عليه مقولة تدفع بالمرء إلى محاولة رصد ما تزخر به الشريعة الإسلامية من أصول وآليات تحصر مواطن هذا التأثر أو التأثير بينهما.
علماً أنه لا فقه بدون واقع يلزم الفقه فيه، ولا واقع معتبر بدون فقه من فقيه، متبع لمنهج نبيه ومسترشداً برشد أئمته، فبإجتهاده في ما يصلح الناس في عصر دون عصر، ومصر دون مصر، وحال دون حال وبفهمه للمسائل والمستجدات، إعتصاراً منه لما حوت أصول الشريعة من قواعد وكليات سانحة لإجتهاده بإستيعاب كل القضايا والمستجدات، مراعياً في ذلك مصالح الناس، إذ زمان ومكان وواقع وحال المسلمين اليوم، تتداعى بين منتصر لهذا الفقه وآخذ به صوتاً لما أصل له الشرع وما عمل به الصحابة وما كان للفقهاء عمل به، وبين المنتصرين إلى القول بإلغائه وبالجمود على النص وإمكانية تنزيله في كل حال وفي كل مكان وزمان، لاغين لكل الضوابط التي من شأنها أن تجعل من القول بتناقض الشريعة وعدم مرونتها، وبالتالي عدم صلاحيتها للقرون الآتية.
