ظهر في الآونة الأخير في دول الخليج وخصوصاً في السعودية ما يسمى بـ"زواج المسيار أو زواج النهاريات) وصورته: أن يتزوج الرجل المرأة بإيجاب وقبول مع الالتزام بالشروط الشرعية في من عقد وشاهد، لكنه يتميز عن الزواج العادي بأن الزوجة فيه تتنازل عن حقها أن ينام زوجها عندها، وتتنازل عن حقها بالعدل بينها وبين الزوجة الأولى وعن النفقة والإرث، وهذا إن الزوج لا يخبر زوجته الأولى بأنه متزوج من ثانية.
هذه الظاهرة الجديدة هي التي دعت الشيخ "نجم الدين الطبسي" إلى إعداد كتابه الذي بين أيدينا والذي يثبت فيه شرعية زواج المتعة وأنه ليس باطلاً كما يدعي البعض كما ويبين فيه حقيقة ومشروعية زواج المسيار، وفتاوى العلماء فيه، ولمحة عن الزواج بنية الطلاق، وذلك بعض إجراءه لنوع من المقارنة بينها زواج المتعة والزواج العادي، وزواج المسيار والزواج العادي بقصد تحديد مكانتهما بالنسبة للزواج الدائم الذي دعت به الشرعية الإسلامية.
