الشيك في أوراق التجارية المهمة والأكثر استعمالا خاصة في البنوك وقد حل محل الأوراق النقدية وترجع نشأة الشيك الى ظهور بنوك الودائع وتعد عملية التوقيع على الشيك تصرفا قانونيا ويترتب عليها التزاما بالوفاء بمبلغه والشيك سلاح ذو حدين فمع انه ييسر الكثير على أصحاب رؤوس الأموال في التعاملاتهم إلا أنه بنفس الوقت يترتب على استخدامه بعض السيئات فقد يضع هذا الشيك أو يسرق من حامله أو قد يلجأ شخص الى تزوير بعض بيانات الشيك مما يلحق ضررا بأصحاب العلاقة فيه وتفاديا لحدوث مثل تلك الأمور فقد ابتعدت بعض الأساليب لتأمين الوفاء بملغ الشيك لحامله الشرعي ومن هذه الأساليب الشيك المسطر والشيك المعد للقيد في الحساب وشرط الدفع بأخطار مسبق والأصل أن الالتزام الثابت في الشيك ينقضي بوفاء مبلغه ومع ذلك فقد ينقضي هذا الالتزام بغير الوفاء.
