انقضاء الدعوى أو سقوطها بالمعنى المتقدم يعني أنه لا يجوز تحريكها بعد ذلك حتى ولو كان المجرم قد تمكن من الإفلات من العقاب المقرر عن جريمته كما في حالة انقضاء الدعوى أو سقوطها بالتقادم.
وفي هذا البحث لن نقتصر على بيان انقضاء الدعوى التأديبية بالنسبة للعاملين المدنيين بالدولة، بل سيشمل العاملين بالقطاع العام، كذلك المخاطبين بأحكام قانون عقد العمل الفردي رقم 91 لسنة 1959، وسوف نشير إلى القوانين التي تنظم الطوائف المهنية المختلفة، حتى يكون مؤلفنا شاملًا بقدر الإمكان للعاملين بالدولة في مختلف القطاعات.
كما ان البحث لن يقتصر على بيان الوضع التشريعي بل سيتعرض لآراء الفقه وأحكام القضاء باعتبارهما مصدرين هامين، يتم بهما شرح أحكام القانون خاصة الغامض منها، وسد أوجه النقض فيها. كما أن الرسالة لن تكتف ببيان موقف التشريع والفقه والقضاء في مصر، بل ستتعرض للوضع في بعض الدول الأخرى التي راعينا في اختيارها أن تكون ذات نظم سياسية ودستورية وتشريعية مختلفة، كما هو الحال في فرنسا والاتحاد السوفيتي وبريطانيا.
وقد قسمنا الرسالة قسمين: القسم الأول وهو مخصص لبيان الأسباب التي تنقضي بها هذه الدعوى خلال الخدمة، أما القسم الثاني فقد قسمناه بدوره إلى بابين الباب الأول نبين فيه الأسباب التي تنقضي بها الدعوى التأديبية بمناسبة ترك الخدمة أما الباب الثاني فموضوعه مدى إمكانية تتبع العاملين تأديبيًا بعد ترك الخدمة.
