Book Description
إنّ حق الإنسان في الحياة والحرية وسلامة جسده من الحقوق الأساسية التي كفلتها الدساتير الوطنية والمواثيق الدولية ومنعت الاعتداء عليها، ولهذا جاءت جميع القوانين الوطنية العامة والخاصة بنصوص تنظم المحافظة على حياة الإنسان، وتعاقب في حال الاعتداء عليها والمساس بها بأشد العقوبات.
حيث نصّت المادة من الدستور الأردني لسنة 1952 على أنه: (الحرية الشخصية مصونة)، وكذلك نصت المادة (326) من قانون العقوبات الأردني رقم (16) لسنة 1960 وتعديلاته لغاية القانون المؤقت المعدل رقم 49 لسنة 2007 على أنه:
(من قتل إنساناً قصداً عوقب بالأشغال الشاقة خمس عشرة سنة)، وكذلك نصت المادة (343) من نفس القانون أنه: (من سبب موت أحد عن إهمال أو قلة احتراز أو عن عدم مراعاة القوانين والأنظمة عوقب بالحبس من ستة أشهر إلى ثلاث سنوات).
علاوة على ذلك، فقد كان قانون السير الأردني المؤقت رقم 47 لسنة 2001 والمعدل بالقانون المؤقت رقم 35 لسنة 2002، وفي المادة 42 منه فقرة (أ) تنص على أنه:
(إذا تسبب سائق المركبة أثناء قيادتها بوفاة إنسان أو تسبب بإحداث عاهة دائمة تضبط رخصة السوق العائدة له ويعاقب بالحبس لمدة لا تقل عن ستة أشهر ولا تزيد على ثلاث سنوات مع سحب رخصة السوق أو وقف العمل بها لمدة لا تقل عن ستة أشهر ولا تزيد على سنة).
وجاء قانون السير الأردني الجديد رقم 49 لسنة 2008 بأحكام أكثر صرامة بخصوص عقوبة التسبب بالوفاة في حادث سير، فنصت المادة 27 من هذا القانون على أنه:
(على الرغم مما ورد في المادة (343) من قانون العقوبات، إذا تسبب السائق بوفاة إنسان أو إحداث عاهة دائمة له يعاقب بالحبس من ثلاثة أشهر إلى ثلاث سنوات أو بغرامة من(1000) ألف دينار إلى(2000)ألفي دينار أو بكلتا هاتين العقوبتين، وعلى المحكمة وقف العمل برخصة القيادة مدة لا تقل عن ستة أشهر ولا تزيد على سنتين).
وكذلك نصت المادة 25 من ذات القانون على أنه:(لأي فرد من أفراد الأمن العام أن يلقي القبض دون مذكرة على سائق أي مركبة وحجز رخصة القيادة ورخصة المركبة وتصريح القيادة وتصريح التدريب إذا ارتكب أياً من المخالفات التالية: أ- التسبب في وفاة شخص أو إيذائه بسبب قيادة المركبة).
