تميز العمل القضائي عن العمل التشريعي بأمور كثيرة يتم بواسطتها تحديد طبيعة كل منهما، ذلك أن الدولة تحدد نطاق الحماية المراد منحها لمصالح معينة بواسطة قواعد سلوك عامة، وتعمل على إشباع هذه المصالح في النطاق الذي حدده القانون إذا لم تحترم قواعده كما يتميز العمل القضائي عن العمل الإداري من منطلقات كثيرة تنبع في معظمها من أن تكييف العمل القضائي يتحدد عندما تقوم به هيئة قضائية، في حين يتم تكييف العمل الإداري بأنه ما تقوم به الإدارة، ولا شك أن العمل القضائي يمتاز عن العمل الولائي بمعايير متفق عليها عند الفقه واجتهادات المحاكم، وتتحدد معايير الاختلاف فيما بين العمل القضائي والولائي، بأن الصفات التي يمتاز بها العمل القضائي تبدو من طبيعة هذا العمل وآثار ما يصدر عن الفقهاء من قرارات. ونناقش في دراسة موضوعات هذا المجلد معنى إدارة الدعوى كما وردت في أحكام قانون أصول المحاكمات المدنية، وأثر استحداث دوائر قضائية لدى المحاكم البدائية بمسمى إدارة الدعوى وتنظيم عملها وفق غايتها التي تهدف الى تحضير الدعوى بكامل أوراقها وتدقيق الطلبات وقبولها لغايات تقديمها الى قاضي الموضوع على نحو تكون جاهزة للفصل.
