التأمينات وفقاً لمفهومها تعني الضمانات أو الوسائل التي يتقي بها الإنسان خطراً معيناً كالتأمينات التي يتم الاتفاق عليها مع شركات التأمين أو كالتأمينات الاجتماعية كضمان الشيخوخة والمرض. لكن التأمينات بمفهومها القانوني الخاص، يقصد بها مجموع الوسائل القانونية التي تهدف إلى ضمان تنفيذ الالتزام أي الضمانات التي تؤمن الدائن من خطر عدن إيفاء دينه، وتتيح له استيفاء حقه عند حلول أجل الدين. والتأمينات بهذا المعنى تفيد الدائن والمدين معاً، أنها تحقق للدائن الطمأنينة والضمان، وتوفر للمدين الائتمان بحيث يتمكن من الحصول على ما يحتاجه من مال وهذا ما يساعد على تعزيز الائتمان وإنماء التجارة والاقتصاد.
