تقوم التأمينات العينية منذ العصور القديمة بدور هام في تشجيع الائتمان، وتنشيط عمليات التسليف، إذا قلما نجد في التعامل من يقبل بأن يمنح الغير ما يحتاج إليه من حال أو أجل، بغير ضمان كاف يؤمنه من خطر إعسار المدين، ويضمن له الوفاء بحقه كاملاً. وإننا نلاحظ أن ما يحصل عليه المدين عادة في ائتمان، يقدر دائماً بالضمانات التي يقدمها. وفي هذا الإطار تظهر التأمينات العينية، كأفضل ضمان يمكن أن يقدمه المدين لدائنيه. ولا سيما بعد التحسن الذي طرأ على قيم الأموال العينية من منقولة وغير منقولة. وعلى الرغم مما تنطوي عليه هذه التأمينات من فوائد للدائن والمدين على السواء، إلا أنها قد تكون سبباً لكثير من الإشكالات القانونية عند التطبيق. ومن هنا، كان لا بد من التصدي لهذه الإشكالات، عن طريق شرح أحكام التأمينات العينية، ومعالجة المسائل القانونية التي يعززها التعامل. وقد استشعر القاضي "حسين عبد اللطيف حمدان" هذه الحاجة من خلال ممارسته القضائية، وقيامه بتدريس التأمينات العينية بكلية الحقوق في جامعة بيروت العربية، فأقبل على إعداد هذا الكتاب. وقد أخذ فيه بطريقة بحث المبادئ التي يقوم عليها نظام التأمينات العينية، في ضوء الاجتهادات القضائية والآراء الفقهية التي صدرت في الموضوع. ونهج في البحث نهج القرار رقم 3339 المتعلق بالملكية العقارية فبدأ بشرح حقوق الرهن، ثم حقوق التأمين، وانتهى بشرح حقوق الامتياز. وقد راعى قدر المستطاع، سهولة الأسلوب، ووضوح العبارة، والبعد عن التفريقات الفقهية المعقدة، ليكون الكتاب مفيداً للطلاب ورجال القانون على السواء.
