جرى العمل في مصر ولبنان، لاعتبارات تاريخية معينة، على الفصل بين مسائل الأحوال الشخصية، ومسائل الأحوال العينية، واختلف الاختصاص القضائي والتشريعي بصددهما، وساد نظام التعدد في الجهات القضائية وتعدد القوانين المطبقة على المواطنين. حاول المشرع الحديث تحقيق الوحدة الوطنية من خلال حركة التوحيد القضائي والتشريعي. بلغ المشرع غايته في تحقيق وحدة القضاء، وفي توحيد التشريع المطبق في مسائل الأحوال العينية، إلا أنه وجد صعوبات جمة في طريق الأحوال الشخصية، فهو وإن كان قد خطى خطوات محدودة في هذا المجال إلا أن جزءً لا يستهان به في تلك المسائل لا زال يخضع لمبدأ تعدد الشرائع المطبقة بحسب ديانة المتقاضين. ونظام الأسرة هو المجال الذي تتعدد بشأنه الشرائع المطبقة حتى اليوم، أي أن شرائع غي المسلمين بطوائفهم العديدة هي التي تحكم المنازعات الناشئة بينهم في هذا الصدد. ولعل دراسة أحكام الأسرة في الشرائع غير الإسلامية أمر ليس باليسير لتعدد تلك الشرائع من جهة وتنوع مصادرها وعدم صياغتها في نصوص قانونية منهجية من جهة أخرى. وتستهل الدراسة التي بين يدينا بباب تمهيدي يعرض فيه للشرائع المنظمة لعلاقات الأحوال الشخصية، ثم تنقسم إلى ثلاثة أبواب للتعرف على النظام القانوني للأسرة في الشرائع غير الإسلامية.
