كل هذه التساؤلات تجسد الإشكالية الرئيسية التي يتمحور حولها الموضوع, فالتطور المستمر والسريع في ميادين العلوم وتكنولوجيات الاتصالات السلكية واللاسلكية, يستدعي ويقتضي بالضرورة أن يكون البحث القانوني مواكباً هو الآخر لهذا التطور المتسارع.
يضاف إلى أهمية هذا الموضوع الذي بين أيدينا أنه لم تتح بعد دراسته بصورة أعمق ولا سيما بالنسبة لتشريعات دول المغرب العربي مقارنة مع دول المشرق والخليج العربيين, إذ لا يعدو أن يكون تناوله هو مجرد محاولات متفرقة.
وأخيراً تتجلى جدوى هذا الموضوع فيما يمكن التوصل إليه من نتائج هامة وما يؤسس عليها من مقترحات عملية, وعلى هذا ارتئينا تقسيم البحث إلى ثلاثة فصول هي: الإثبات في تشريعات دول المشرق العربي, الإثبات في تشريعات دول الخليج العربي, الإثبات في تشريعات دول المغرب العربي.
